Sample Parenting Responsibility Documents

 

The following are standard model parenting responsibility documents intended to be implemented by mutual consent of the parties involved.  Please note that these documents have been based on actual agreements and have been altered to remove names and to make them more general in nature.  These documents are designed to be posted as a guide only to those persons needing ideas during the preparation of their own proposed parenting agreements or Orders and that the wording of some of the clauses will have to be altered to suit specific situations.  Before finalizing any parenting document you should take it to a family law lawyer who supports the concepts of shared parenting and joint custody and have it reviewed to ensure that it covers all of the factors relative to your own case.

Equal Parenting Responsibility Agreement

This agreement is based on an arrangement where parents will share the responsibilities of the children on a fairly equal and consistent basis.  This arrangement is most suitable for parents who live close to each other and are able to easily facilitate taking the child to the school and other activities attended by the child.

 

For preschool children

This standard agreement linked here is based on parents having the child 50% of the time with the child requiring daycare during the times when the parents are at work.

Shared Parenting Responsibility Agreement

This agreement is agreement is based on an arrangement where parents share the responsibility of of children on as close to equal basis as possible taking into consideration those factors that prevent them from participating in an equal parenting agreement.  This would be most applicable to parents that live far enough away from each other that an equal parenting arrangement would not be possible.

Sole Custody Responsibility Agreement

This parenting responsibility document is based on an arrangement where one parent carries the overwhelming responsibility and decision-making of the children because reasons exist that do not allow an Equal or Shared Parenting situation to be implemented.  Sole custody arrangements may be agreed to when one parent is physically or emotionally unfit to carry their parenting responsibilities.  Even with a sole custody arrangement, as many of the concepts and principles as possible which are known to ensure fairness and reduce conflict are incorporated into the document.
